Membership agreement, facility access & operational terms

1.1 Agreement & private facility scope

This Agreement is entered into by and between Upstate Tee House, LLC (“Upstate Tee House,” “UTH,” “the Club,” “we,” “us,” or “our”) and the undersigned Member (“Member”). UTH operates a private, members-only indoor golf facility located at 810 Powdersville Road, Suite D, Easley, SC 29642. Membership grants Member access to UTH’s simulator bays, Uneekor launch monitors, software, and club amenities subject to the membership plan selected, availability, posted instructions, and full compliance with this Agreement. Membership is personal to Member and may not be sold, transferred, shared, or assigned without prior written approval from UTH. UTH reserves the right to modify facility policies, technology, equipment, membership benefits, and operating procedures when reasonably necessary for the operation of the club.

1.2 Membership fees, recurring dues & payment processing

Member agrees to pay all recurring membership dues, initiation fees, and applicable charges associated with Member’s selected membership plan. Dues are billed automatically in advance on a recurring monthly or annual basis through UTH’s designated payment processor (Stripe) and continue until properly canceled or terminated in accordance with Section 1.3. Member authorizes UTH and its payment processor to charge the credit or debit card provided for all amounts due under this Agreement. Member must maintain a valid, active payment method on file at all times through the Member Portal (members.upstateteehouse.com). Failed or declined payments will result in automated immediate suspension of facility access and booking privileges until the account balance, including any bank decline fees, is brought current. Annual or prepaid memberships are committed for the entire term purchased and are non-refundable.

1.3 Membership cancellation & refund policy

1. Cancellation notice. Member may cancel recurring monthly membership by submitting an official cancellation request via the Member Portal or via written email notice to UTH management at least thirty (30) days prior to the next scheduled recurring billing date.
2. No prorated refunds. All membership dues, initiation fees, and simulator fees are non-refundable once billed. Cancellations received with less than 30 days’ notice will take effect at the conclusion of the subsequent billing cycle. UTH does not provide partial-month refunds, prorated credits, or refunds for unused simulator time.
3. Annual & prepaid plans. Early cancellation of an annual or promotional prepaid membership forfeits any remaining prepaid period.
4. Re-enrollment. Any former member seeking to rejoin following cancellation or payment default is subject to facility waitlists, prevailing membership pricing, and payment of standard initiation or re-enrollment fees.

1.4 Simulator bay booking, scheduling & no-show policy

1. Advance bookings. Simulator bays must be reserved in advance through UTH’s designated booking system at members.upstateteehouse.com. Reservations are for legitimate personal use only; Member agrees not to reserve excessive, speculative, or unnecessary blocks of time, nor sell or transfer reservations without UTH approval. UTH may establish or modify reservation windows, booking limits, advance rolling booking windows, and other scheduling rules.
2. Cancellation window. If Member cannot utilize a reservation, Member must cancel the reservation online at least two (2) hours prior to the scheduled start time to release the bay for other members.
3. Late cancellation & no-show fees. Reservations canceled less than 2 hours prior to start time, or failure to check in within fifteen (15) minutes of the reserved start time (“No-Show”), will result in an automated $25.00 Late Cancellation / No-Show Fee charged to Member’s payment card on file. Repeated no-shows or late cancellations may result in temporary or permanent restriction of advance booking privileges.
4. Prompt turnover. Member must use only the bay and time reserved and must promptly vacate the bay upon session expiration (beginning packing equipment 5 minutes prior) so the subsequent reservation can start promptly.

1.5 Unmanned self-service facility & keyless access rules

Member acknowledges that UTH operates as an unmanned, self-service private golf facility and that staff, employees, or managers may not be present on the premises at all times. Facility access is controlled through electronic locks, mobile credentials, access codes, or key fobs. Member agrees:

1. not to share, loan, duplicate, or disclose access credentials or entry codes to unauthorized individuals;
2. not to prop open or defeat security doors;
3. not to permit unauthorized persons to enter the facility;
4. to ensure that entrance doors securely close and latch when entering and leaving;
5. to immediately report lost, stolen, or compromised credentials; and
6. to follow all posted safety and facility instructions.

Allowing unauthorized individuals to enter (“tailgating”) or sharing access credentials will result in an immediate $150.00 Unauthorized Access Violation Fee charged to Member’s account, immediate revocation of facility access, and termination of membership for cause. Member is strictly accountable and financially liable for any entry gained through Member’s credentials.

1.6 Guest policy & assumption of complete vicarious guest liability

Members are permitted to bring guests subject to their membership plan allowance (maximum three (3) accompanying guests per bay reservation; maximum four (4) active persons per bay). The sponsoring Member must be physically present on the premises inside the reserved bay at all times while guests are in the facility; unaccompanied guests are strictly prohibited. Outside commercial golf instruction or paid coaching is prohibited without prior written approval from UTH. The signing Member agrees and warrants that Member assumes 100% full supervisory, legal, and financial liability for the actions, omissions, conduct, and safety of every guest (adult or minor) brought to UTH under Member’s reservation. Member is strictly responsible for ensuring all guests comply with all House Rules, safety regulations, and facility policies, and Member agrees to pay in full for any damage caused by Member’s guests.

1.7 Termination & suspension for cause

UTH reserves the right to immediately suspend access or terminate membership without refund for:

1. failure to pay membership dues or other amounts owed;
2. violation of this Agreement, House Rules, or facility policies;
3. unsafe, threatening, abusive, or disruptive conduct;
4. damage to UTH property or equipment;
5. unauthorized access or sharing access credentials;
6. allowing unauthorized persons to enter;
7. theft or suspected theft;
8. misuse or tampering with simulator equipment;
9. conduct that creates a safety risk to another person, the facility, or UTH; or
10. violation of applicable law.

Termination for cause does not relieve Member of responsibility for unpaid dues, charges, or damages caused by Member or Member’s guests.

House rules, simulator safety & property damage policies

“Play Safe. Respect the Club. Have Fun.”

2.1 Core philosophy & respect for the club

Upstate Tee House is designed to be a private, self-service golf club where members and their guests can enjoy the facility on their own schedule under the guiding doctrine: “Play Safe. Respect the Club. Have Fun.” All members and guests are required to help keep UTH safe, clean, and enjoyable for everyone.

2.2 Safety first & the one-golfer-at-a-time rule

Always make sure the area is completely clear before swinging any club. Only one (1) person should be actively swinging a club in the hitting area at a time. Everyone else must remain behind the designated safety area line. Never swing a club when another person is inside your swing path or hitting area. Keep people outside the designated hitting/swinging area at all times.

2.3 Watch your club & mat boundaries

Be aware of your surroundings at all times, especially when making practice swings. Never swing a club outside the designated hitting area. Remain conscious of club path, ceiling clearance, overhead tracking monitors, side baffles, and enclosure framing.

2.4 Approved simulator golf balls & directional play

Only use clean golf balls appropriate for the simulator. Do not intentionally hit balls toward walls, doors, ceilings, furniture, or other areas of the facility. Never use scuffed, dirty, cracked, or Sharpie-marked golf balls, as ink markings transfer to and permanently destroy impact screens.

2.5 Footwear standards

Only clean, spikeless golf shoes or clean, dry athletic footwear are permitted on simulator turf. Dirty footwear, metal spikes, work boots, dress shoes, and high heels are strictly prohibited.

2.6 Protect the equipment & strict prohibition against tampering

UTH bays contain precision commercial simulator equipment, laser projectors, Uneekor launch monitors, high-performance computers, custom impact screens, hitting surfaces, and enclosure structures. Participants must treat our simulators and equipment as they would their own.

Strictly prohibited:

1. Moving, adjusting, or bumping launch monitors;
2. Moving, adjusting, or realigning projectors;
3. Disconnecting cables, wiring, or power supplies;
4. Tampering with computers, software settings, or surveillance systems;
5. Hitting screens with golf clubs;
6. Climbing on enclosures, baffles, or netting;
7. Throwing or slamming golf clubs;
8. Attempting to repair equipment.

If something isn’t working correctly, please stop use and report it to UTH immediately rather than trying to fix it.

2.7 Property damage responsibility & direct cost recovery

Member agrees to use reasonable care when using UTH’s property and equipment. Member is directly financially responsible for all reasonable repair or replacement costs resulting from intentional, reckless, or negligent damage caused by Member or Member’s guests, to the extent permitted by law. This includes, without limitation, damage to simulator screens, launch monitors, projectors, computers, hitting surfaces, golf clubs, walls, doors, furniture, fixtures, or other UTH property. UTH will determine the reasonable cost of repair or replacement based on actual market replacement prices and professional labor. Member expressly authorizes UTH to charge Member’s payment method on file for all verified damages.

2.8 Alcohol & responsible conduct policy

Alcohol may be consumed at UTH on a responsible basis only when permitted under applicable law and UTH policies. Please drink responsibly. Never golf, swing a club, or operate simulator equipment while impaired or intoxicated to the point that you cannot safely use the facility or interact with others. Providing alcohol to minors is strictly illegal. UTH reserves the right to require any person who appears intoxicated or whose conduct creates a safety concern to cease using the facility and leave the premises immediately. Illegal drugs and controlled substances are strictly prohibited on club property at all times.

2.9 Code of conduct & zero-tolerance violations

UTH is a private club. Treat the facility, members, guests, and neighbors with respect. The following conduct is strictly prohibited:

1. fighting, physical altercations, or threatening behavior;
2. discrimination or unlawful harassment;
3. excessive noise or disruptive behavior;
4. illegal drugs or contraband;
5. theft, suspected theft, or vandalism;
6. deliberate damage to property;
7. unauthorized use of another person’s membership or credentials;
8. illegal activity; or
9. any unsafe conduct creating an unreasonable safety risk.

UTH reserves the right to immediately remove anyone whose behavior creates a safety concern or violates club rules.

2.10 Minors & children

Minors under eighteen (18) years of age must be appropriately and continuously supervised by their parent, legal guardian, or sponsoring adult Member at all times. Children must remain outside the designated hitting area unless actively participating under appropriate, hands-on adult supervision.

2.11 Cleanliness & departure (“Leave it better than you found it”)

Please leave your bay and common areas as you found them. Before leaving UTH:

1. clean your bay and throw away all trash in receptacles;
2. clean up any liquid spills immediately;
3. return clubs, tees, and equipment to designated locations;
4. take all personal belongings with you;
5. do not leave open food or drinks in simulator areas; and
6. confirm the facility is secure, and make sure the door is closed and securely locked.

2.12 Something wrong? Incident & emergency reporting

If you notice an injury, damaged equipment, a water leak, electrical issues, security concerns, a malfunctioning simulator, or anything else that could create a safety issue: stop using the affected area and notify UTH immediately at (864) 671-0464. For emergencies or situations requiring immediate emergency assistance, call 911 immediately.

Assumption of risk, medical fitness, waiver of liability & indemnification

3.2 Medical condition & physical fitness

Member represents and certifies that Member and Member’s guests are physically capable of participating in golf and using the simulator facility. Member is responsible for determining whether participation is appropriate for Member’s and guests’ physical condition. Member agrees to stop participation immediately and seek medical care if Member experiences pain, dizziness, shortness of breath, illness, or another condition that makes continued activity unsafe.

3.5 Personal belongings disclaimer

Member is solely responsible for personal belongings brought onto the premises. UTH is not responsible for lost, stolen, or damaged personal property except to the extent liability cannot lawfully be excluded. Members and guests should not leave valuables unattended.

3.6 24/7 security camera surveillance

For safety, security, and property-protection purposes, portions of the UTH facility are monitored by video surveillance consistent with applicable law. By entering the facility, Member acknowledges and consents to reasonable security video monitoring for Member and Member’s guests. UTH will not intentionally place surveillance cameras in areas where individuals would reasonably expect privacy, such as private restrooms.

3.7 Governing law & severability

This Agreement shall be governed by and interpreted in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles. Any provision determined to be unenforceable shall be modified or severed to the minimum extent necessary, while all remaining provisions shall remain in full force and effect to the extent permitted by law.

3.8 Entire agreement & non-oral modification

This Agreement, together with applicable UTH membership terms, House Rules & Safety, and booking policies, constitutes the entire agreement between Member and UTH concerning membership and facility use. No verbal representation or promise modifies this Agreement unless confirmed in writing by UTH.

Acknowledgment, guest responsibility & binding execution

Signer must be 18+ years old.
